Terms of Service

By accessing or using AIRUDA ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

1. Acceptance of Terms

By accessing or using AIRUDA ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

AIRUDA is operated by Airuda Labs, LLC ("Company", "we", "our"). The Service provides multi-modal AI conversation platform with marketplace ecosystem for AI prompts and automation workflows.

2. Account Registration and Security

Account Creation: You must provide accurate, current, and complete information during registration. You are responsible for maintaining the security of your account credentials.

Email Verification: Email verification is required to access full Service features. We send verification emails to confirm account ownership.

Age Requirement: You must be at least 13 years old to use the Service. If you are old enough to use AIRUDA but local law still requires parent or guardian permission for someone your age, you must have that permission before using the Service.

Account Security: You are solely responsible for all activities under your account. Notify us immediately of any unauthorized access.

3. AI Services Usage

Multi-Modal AI: The Service provides access to AIRUDA's current text, image, and video AI capabilities through third-party providers such as OpenAI, Anthropic, Google, Recraft, BFL AI, Stability AI, and Runway. Specific models and generations may change over time as the Service evolves.

AI Limitations: AI-generated content may contain errors, inaccuracies, or biases. We do not guarantee accuracy, completeness, or suitability of AI responses for any particular purpose. You are solely responsible for verifying AI-generated content before use.

No Professional Advice: AI services do not constitute professional advice (legal, medical, financial, or otherwise). Consult qualified professionals for important decisions.

Content Moderation: We reserve the right to moderate, filter, or remove AI-generated content that violates these Terms or applicable laws.

4. Marketplace and Creator Economy

Marketplace Prompts: The marketplace offers AI prompts created by users ("Creators"). Prompts include text prompts (AI personalities), image prompts (style templates), video prompts (scene templates), and workflow automation.

Creator Revenue: Creators can publish prompts publicly before KYC in non-monetized mode. After Stripe Connect verification and AIRUDA tax/compliance checks, AIRUDA unlocks the monetization path supported for the creator's legal country. Some countries are conversion-only, which means creators can accrue value and convert it into AIRUDA paid credits, but cash payout requests stay unavailable. AIRUDA keeps the platform base price, and creators earn only the creator markup layer from paid public-credit usage. Free-credit usage does not generate creator revenue.

Creator Responsibilities: Creators are solely responsible for prompt quality, accuracy, and compliance with laws. Creators retain intellectual property rights to their prompts. Publishing grants us license to distribute and execute prompts for platform operation.

Quality Standards: Published prompts must meet minimum quality score (evaluated by AI) and pass safety review. We reserve the right to unpublish prompts that violate Terms or receive poor user feedback.

User Reviews: Users who have used a prompt 10+ times may submit reviews. Reviews reflect individual user experiences and are not endorsed by the platform. Creators may respond to reviews.

No Guarantee of Earnings: Creator revenue depends on marketplace adoption and user usage. We make no guarantees about earnings potential.

5. Credits and Billing

Credit System: The Service uses prepaid credit system. 1,000 credits = $1.00 USD. All purchases settled in USD. Local currency shown as estimate only.

Free Credits: New accounts receive a one-time 3,000-credit signup bonus. On the 1st of each month, if your free balance is below 1,000, AIRUDA tops it up to 1,000. Free credits do not generate creator revenue.

Paid Credits: Purchased credits fund creator revenue only on the creator markup layer of public prompts. Paid credits can go negative from estimation overages up to the -1,000 credit limit.

Purchase Rails: AIRUDA uses one shared paid-credit wallet across iOS, Android, and web. Mobile apps use Apple App Store or Google Play credit packs, while web uses Stripe for direct top-ups, saved cards, and Auto-Recharge management. Creator monetization follows AIRUDA's legal-country policy, so some countries support AIRUDA paid-credit conversion only and do not open cash payout requests.

Pricing: AIRUDA shows users one final marketplace price. Raw AI provider cost is not exposed. Private prompts and platform defaults use the AIRUDA base price only, while public prompts may add a creator markup on top of the AIRUDA base price.

Auto-Recharge: Optional auto-recharge available (web setup). Executed when paid credits below threshold. Three consecutive failures auto-disable feature.

Refunds: Purchases billed through Apple App Store or Google Play follow the tools and policies of those stores. Apple refund requests are submitted through reportaproblem.apple.com. Google Play refund requests follow Google's refund flow, and Google says that after 48 hours users should contact the developer for purchase issues or refund help under the developer's policies and applicable law. Web direct top-ups are generally non-refundable except where required by law. Unused credits remain in your account with no expiration, and negative balances from overages must be cleared before continued AI usage.

Billing Disputes: Contact support within 30 days of charge with transaction correlationId for investigation.

6. Workflow Automation and User Responsibility

Automation Platform: The Service provides workflow automation tools (similar to Zapier, n8n, IFTTT) as part of AI prompts. Workflows can connect to external APIs, send HTTP requests, and automate tasks.

Configuration Equals Awareness: When you configure workflow parameters (API keys, endpoints, credentials), you explicitly acknowledge what the workflow will do. Parameter input IS conscious enablement.

User Responsibility: You are solely responsible for: (1) APIs you connect, (2) Credentials you provide, (3) Parameters you configure, (4) Automation outcomes executed, (5) Strategy judgment (platform doesn't evaluate if your configuration is "wise").

Platform Responsibility: We provide: (1) Safe automation infrastructure (encrypted storage, rate limits, HTTPS, timeout enforcement), (2) Quality baseline (AI score 60+, content moderation, README clarity), (3) Secure execution (tools work as documented).

No Financial Services: AIRUDA is an automation tool platform, not a financial advisor or broker. We provide no investment recommendations. User-created trading automations are user responsibility. We follow Zapier/n8n precedent for financial API automation without being regulated as financial services.

Execution Limits: Workflows enforce safety limits: Max 100 loop iterations, max 20 AI calls per execution, max 5 minutes execution time, max 50 nodes per workflow. These prevent resource abuse while allowing legitimate automation.

7. Prohibited Uses

You may not use the Service to:

  • Violate any applicable laws or regulations
  • Infringe intellectual property rights of others
  • Generate, store, or distribute illegal content (drugs, weapons, adult content involving minors, illegal services)
  • Harass, abuse, or harm others
  • Impersonate others or misrepresent affiliation
  • Distribute malware or conduct cyber attacks
  • Manipulate marketplace (fake reviews, self-revenue farming, artificial usage inflation)
  • Reverse engineer or attempt to extract proprietary algorithms
  • Resell or redistribute Service access without authorization
  • Use automated tools to scrape or data mine the Service

8. Privacy and Data Usage

Our Privacy Policy explains how we collect, use, and protect your data. By using the Service, you consent to our privacy practices.

AI Provider Data Sharing: Your AI conversations are sent to third-party AI providers (OpenAI, Anthropic, Google, Stability AI, Runway) solely for generation purposes. We do not sell your data.

User Rights: GDPR provides rights to: access your data, export your data, request deletion, correct inaccuracies. Contact privacy@airuda.com for data requests.

9. Limitation of Liability

Service "AS IS": The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee: (1) Uninterrupted availability, (2) Error-free operation, (3) AI accuracy or quality, (4) Specific results or outcomes.

Liability Cap: Our total liability to you for all claims arising from Service use shall not exceed the amount you paid us in the past 12 months, or $100 USD, whichever is greater.

No Consequential Damages: We are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, data loss, business interruption, trading losses from automated workflows, reputational harm.

Third-Party Services: We are not responsible for: (1) AI provider outages or quality issues, (2) External APIs you connect via workflows, (3) Stripe payment processing failures, (4) Email delivery failures.

10. Dispute Resolution

Informal Resolution: Before filing any claim, you agree to contact us at support@airuda.com to attempt informal resolution. We commit to good faith resolution efforts within 30 days.

Arbitration: Except where applicable law gives you a non-waivable right to use local courts or consumer procedures, disputes not resolved informally shall be resolved through binding arbitration under the rules of the American Arbitration Association, on an individual basis only (no class or representative actions).

Governing Law: These Terms are governed by the laws of the State of Delaware, United States, except to the extent mandatory consumer-protection or other non-waivable local law applies.

11. Account Termination

Your Rights: You may close your account at any time through Settings. Any refund rights continue to follow the original purchase rail and applicable law. AIRUDA then removes or anonymizes personal data according to the Privacy Policy while retaining only the non-live records it is legally required to keep.

Our Rights: We may suspend or terminate accounts that: (1) Violate these Terms, (2) Engage in abusive behavior, (3) Create security risks, (4) Remain inactive for 2+ years with no credits or data.

Effect of Termination: Upon termination: (1) Your access ends immediately, (2) Your public prompts are unpublished and removed from marketplace discovery, (3) Personal data is deleted or anonymized per the Privacy Policy retention schedule, and (4) any required financial, tax, fraud-prevention, or compliance records may remain in retained, non-live form as required by law.

Changes to These Terms

We may update these Terms occasionally. We will notify you of material changes via email and in-app notification. Continued use after changes constitutes acceptance of updated Terms.
